"EXHIBIT 0" <br /> Lessee agrees to keep separate records pertaining <br /> strictly to the acreage defined in this agreement, being <br /> Exhibit "A" , and Lessors shall have the right to inspect, <br /> upon reasonable notice, Lessee ' s books and records at <br /> reasonable times and places. Lessors shall have the option, <br /> at their expense, to audit Lessee ' s accounts, books and <br /> records in relation to the royalty payments made pursuant to <br /> this lease. <br /> Lessee shall pay to the Lessors the amount of the total <br /> royalties on or before the fifteenth (15th) of each month <br /> following the month during which the material was removed <br /> from the premises . Lessee shall forward to the Lessors with <br /> each royalty payment a monthly report showing the quantity of <br /> materials removed during the preceding month if said reports are <br /> requested, and such reports shall contain records kept by the Lessee <br /> showing the quantity of materials loaded. <br /> If Lessee at any time removes materials in excess of <br /> which they have paid royalties, of which they shall have <br /> become obligated, the Lessee shall be in default under the <br /> lease and shall have seven (7) days to correct such default <br /> after notice from Lessors . Failing to do so, Lessors shall <br /> have any and all remedies at law or equity, together with <br /> any and all remedies provided under this 1-ease in the event of <br /> defaul.t. <br /> 3 . Surface Rights <br /> Lessee may excavate test holes , clear brush and under- <br /> growth, if any, from such portion of the leased premises as may <br /> be reasonably necessary to explore for materials or to locate pit <br /> quarries . In order to obtain access to the leased premises the <br /> Lessee shall have the exclusive right and use of all roadways <br /> presently existing on the leased property. <br /> Lessee further agrees , during the first year of the <br /> initial term of this lease, to allow or plan his excavation <br /> so as not to interfere with or disturb the farming or crops <br /> "EXHIBIT O" Source of Legal Right to Enter <br /> Page -4 3 <br />
