"EXHIBIT O" <br /> L E A S E <br /> THIS LEASE, made thisliz�—day of 1979 , <br /> by and between WILLIAM V . BROMLEY and DONA MAE BROMLEY, <br /> hereinafter referred to as "Lessors , " and STRONG BROS . <br /> EXCAVATING, INC. , a Colorado corporation, hereafter referred <br /> to as "Lessee, " <br /> W I T N E S S E T I1: <br /> LESSORS, in consideration of the mutual promises set <br /> forth herein and the payment of royalties by the Lessee as <br /> provided herein, and subject to the Lessee that certain tract <br /> of land situate in the County of Adams , State of Colorado, known <br /> by the street address of 7281 Colorado Boulevard, Commerce City, <br /> Colorado (unincorporated Adams County) , and also legally described <br /> in Exhibit "A" attached hereto, and hereinafter referred to as <br /> the "property" , for the purpose of quarrying, mining, r.emovinq and <br /> marketing therefrom all sand, gravel , rock and clays on the premises <br /> which are hereinafter referred to as "materials . " <br /> IT IS AGREED between the parties that the above parcel <br /> of land described in Exhibit "A" consists of approximately <br /> 16 . 4 acres more or less , but which includes residential structures <br /> and yards (a main residence and two otht.r smaller dwellings <br /> together with a steel building) which are. npecifica.l. Ly excluded <br /> from this lease and less easements to these residences except <br /> that Lessors may waive this exception or any portion thereof, <br /> from the leased property in writing to the Lessee, permitting <br /> mining within these areas once the buildings have been demolished <br /> and removed, which shall be demolished, if at all, by Lessors , <br /> with the further condition that Lessors may retain Lessee for <br /> the demolition purpose and compensate him for the same by <br /> crediting the cost of the demolition against the royalty payments <br /> hereunder .
