_~~~ ~ ) O Y <br />~ ~ • /\ <br />1128 MAIN STREET (719) 275-8881 ~i <br />CANON CITY, COLORADO 81212 <br />Energy Fuels Coal, Inc. <br />Mr. Alan Weaver <br />Southfield Mine <br />1190 County Road 92 <br />Florence, CO 81226 <br />RE: CERTIFICATION OF SEDIMENTATION POND N0.5, SOUTHFIELD <br />MINE, FLORENCE, COLORADO (3rd Quarter, 1998) <br />Dear Al; <br />On September 30, 1998, an inspection was conducted on the Sedimentation Pond <br />No. 5 currently in place at your Southfield mine. The inspection was performed by myself, <br />John Effinger III, a registered professional engineer in the State of Colorado since <br />December, 1975. I have experience and knowledge in the design and construction of <br />dams, drainage control, hydrology and structures; including experience in portions of the <br />permitting process of coal mine facilities and permit compliance. <br />The purpose of this inspection and certification was to check for structural <br />weakness, erosion, other hazardous conditions and identify required maintenance and to <br />satisfy the requirements of Rule 4.05.6 (13) of the Colorado Mined Land Reclamation <br />Board for Coal Mining. In addition to the on site inspection referenced above, actions <br />taken in preparing this certification included review and discussion of applicable mine <br />maps and state regulations with yourself. <br />Said inspection was performed on a warm and sunny (80°), Wednesday mid- <br />morning by myself. Most of the site was traversed with a motorcycle with frequent stops <br />and hiking trips over, across and azound the structure. The following is a statement of my <br />professional observations and conclusions from this inspection: <br />The entire pond was examined for structural weakness, erosion, and other <br />hazardous conditions; none were found. <br />Existing water level in the pond was 12" below the bottom of the pond decant <br />gate. <br />Small erosion rill on east bank has widened slightly at top. <br />
