The inspection was performed by myself, John <br />Effinger III, a registered professional engineer in the State of Colorado since December, <br />1975. I have experience and knowledge in the design and construction of dams, drainage <br />control, hydrology and structures; including experience in portions of the permitting <br />process of coal mine facilities and permit compliance. <br />The purpose of this inspection and certification ~+~as to ensure that proper <br />construction and maintenance techniques were being utilized in accordance with the <br />approved refuse disposal plan and to satisfy the requirements of Rule 4.10.2 (1) of the <br />Colorado Mined Land Reclamation Board for Coal Mining. In lieu of bi-annual field <br />compaction testing performed by your consultant, Lincoln DeVore, compaction was <br />monitored during this inspection with a "proof-rolling" observation of the active pile. In <br />addition to the on site inspection referenced above, actions taken in preparing this <br />certification included review of the re-evaluated stability analysis performed by your <br />consultant, Terra Matrix, dated December 9, 1996, and revie+v and discussion of several <br />applicable mine maps and state regulations with yourself at your mine site office. <br />Said inspection .vas performed on a mild (77°), partly cloudy Tuesday morning by <br />myself Most of the site +vas traversed with a four wheel drive vehicle +vith frequent stops <br />and hiking trips over, across and around the pile. The follo+ving is a statement of my <br />professional observations and conclusions from this inspection: <br />The entire pile was examined for any failures and none found. <br />The entire pile was checked for any springs or seeps and none found, very little <br />standing water leas observed. <br />
