Cottony <br />Division Director <br />Natural Resource Trustee <br />This letter is in response to a request for guidance from Troy Summers, WWC Engineering, on <br />this date. The question had to do with timing and relationships of termination of water <br />monitoring, removal of water monitoring equipment, and Phase II and Phase III bond release. <br />Guidance is to submit a Technical Revision that terminates water monitoring programs of Permit <br />C-1980-001 on the same date that an application for final Phase III bond release is submitted. <br />Information in the Technical Revision application should demonstrate that monitoring is no <br />longer required [see Rules 2.05.6, 3.03.2(2), and 4.05.13(3)(6)]. Upon approval of the Technical <br />Revision application, monitoring could be terminated and the sites be reclaimed [Rules <br />4.05.13(1)(e)(ii) and 4.05.13(3)(a)]. Reclamation compliance at the water monitoring sites would <br />be inspected before, or during, the Phase [II Bond Release on-site inspection. <br />This guidance does not apply to the water monitoring requirements of the Colorado Department <br />of Public Health and Environment.
