The Referee does find that the claimant has exercised reasonable
diligence in the development of: the conditional water right previously
awarded to Riverbend Wells No. 1, PIo. 2, No. 4 and No. 5, as well
as the 0.23 remaining conditionally awarded to Riverbend Well No.
3; and therefore concludes that the conditional water rights be
continued in full force and effect.
The Referee does further conclude that the claimants request
that 0.23 cubic foot: of water per second of. time remaining condi-
tionally awarded to Riverbend Well No. 3, and the 0.67 cubic foot
of water per second of time ataarded conditionally to I'.iverbend No. 4
be made absolute and unconditional, should he and hereby is denied.

quadrennial finding of reasonable diligence shall be filed in htarch
of 1986 and in Atar.ch of every fourth calendar year thereafter so
long as the claimant desires to maintain the conditional water
right or until a determination bias been made that the conditional
water right has become an absolute water right by reasontof;,the,~~;.;(,,/t~'~,a
completion of the appropriation. "~
It is accordingly ORDERED that this ruling shall be filed with
the Water Clerk and shall become effective upon such .filing, subject
to judicial review pursuant to Section 37-92-309 CRS 1973.

with the appropriate; Division Engineer and the State Engineer.
