<br />for Garfield County, entered September 14, 1908.

<br />in October 10, 1973 Revised Priority List for Water
<br />Division 5, Priority No. 2.42, being Ditch No. 106
<br />in District No. 39, for 4.0 cfs., appropriation date
<br />October 8, 1942, adjudicated by Decree of the District
<br />Court in and for Garfield County, entered September 5,
<br />1952.
<br />The decreed point of diversion is from Canyon Creek
<br />at a point on the West bank thereof whence the corner
<br />common to Sections 23, 24, 25 and 26, Township 5
<br />South, Range 90 West bears South 89°06' West 1632.7
<br />feet, variation 15° East. The actual point of diver-
<br />sion is and apparently always has been at a point on
<br />the West bank of Canyon Creek in the N471/4 SW1/4
<br />Section 25, Township 5 South, Rarge 90 West of the
<br />6th P.M.
<br />b. The following wells, as conditionally decreed by the
<br />Water Court in and for Water Division No. 5 by the
<br />Referee's Ruling of March 21, 1974, in Case Number
<br />W-2125, for 0.67 cfs. each, appropriation date June
<br />1, 1973, located as follows:

<br />west Corner of Section 35, Township 5 South, Range
<br />90 West of the 6th P.M. bears South 02°30' West 2680
<br />feet.
<br />Riverbend Well No. 2: At a point whence the South-
<br />west Corner of Section 35, Township 5 South, Range
<br />90 West of the 6th P.M., bears South 10°30' West
<br />2600 feet.
<br />Riverbend Well No. 3: At a point whence the South-
<br />west Corner of Section 35, Township 5 South, Range
<br />90 West of the 6th P.M., bears South 18°00' West
<br />2610 feet.
<br />Riverbend Well No. 4: At a point whence the South-
<br />west Corner of Section 35, Township 5 South, Range
<br />90 West of the 6th P.M., bears South 26°00' West
<br />2590 feet.
<br />Riverbend Well No. 5: At a point whence the South-
<br />west Corner of Section 35, Township 5 South, Range
<br />90 West of the 6th P.P4.. bears South 34°3G' West
<br />2675 feet.
<br />4. The source of supply for the domestic water service
<br />
<br />for applicant's development will be water diverted from the Colo-
<br />rado River alluvium. This water will be directly applied to
<br />municipal-type purposes to supply the development through a central
<br />water supply system. The means of diversion of such water will be
<br />through Riverbend Wells 1, 2, 3, 4 and 5. In order to provide water
<br />service through its central system during times of the year when its
