Varra and Janes: <br />RECE'`.~ED <br />FEB 0 2 2004 <br />Division of Mirte~a~s a Gau1nYY <br />The Department of Planning Services reviewed the materials, inciuding the photographic maps of the site, <br />provided by your office for the proposed amendments io the existing Special Use Permi[ (SUP-345j that is <br />on record with 'JVeld County Government and provided comments to Bradford Janes in a letter dated <br />January 5, 2004. <br />Part of the discussion provided byWeld County Government deals with the issue of the floodwa~, ~~ <br />floodplain and the Cache La Poudre river corridor. The City of Greeley in Their letter dated December 16, <br />2003 raised questions associated with berms and dikes adjacent to the southern edge of the river corridor. <br />The City states that a majority of the mining activities are within the Floodway as delineated on both the <br />FIRM Community Panel Map(s) and the 2003 Army Carps of Engineers Floodway boundary study. As <br />stated in the Greeley letter, the current mining operation is located in the Floodway as delineated on the <br />1990 FIRM Community Panel Maps and the recently completed Army Corps of Engineers study <br />commissioned by the City of Greeley. Weld County government will adopt the Army Corps of Engineers <br />study subject to the approval and adoption by FEMA, under whom Weld County administers the National <br />Flood Insurance Program. Both studies delineate the area adjacent to the river corridor as Floodway, and <br />by Weld County Cade, no development shall occur in the Floodway zone, including the alteration, <br />relocation and modification to a known and existing watercourse, which in this instance would include the <br />adjacent build-up of land south of the river. <br />Information provided by Mr. Janes for the amendment review by the Division of Minerals and Geology, <br />dated August 26, 2003, Exhibit G -Water Issues, paragraph 4 and paragraph 5 notes prior knowledge of <br />floodway and floodplain respective to past activities and present operations. This document further states <br />in Exhibit I and J that there is an existing levee adjacent to the river.
