.~ ~ iJ. ~~ <br />ADMINISTRATIVE REVIEW (40 CFR 5124.191 <br />1. Any person who filed comments on the tentative permit decision <br />or participated in any public hearing on such decision may <br />petition the Administrator to review any condition of the <br />final permit decisions. <br />2. Any person who failed to file comments or participate in any <br />public hearing on the tentative permit decision may petition <br />for administrative review only to the extent of the changes <br />from the tentative to the final permit decision. <br />The petition must include a statement of the reasons <br />supporting that review, including a demonstration that any <br />issues being raised in the petition were previously raised <br />during the public comment period or during any public hearing <br />and, when appropriate, a showing that the condition in <br />question is based on: <br />a. A finding of fact or conclusion of law which is clearly <br />erroneous; or <br />b. An exercise of discretion or an important polic: <br />.consideration which that Administrator should, in his or <br />her discretion, review. <br />4. Such a request must be made within thirty (30) days of service <br />of notice of the Regional Administrator's action, and shall be <br />mailed to: <br />U.S. Environmental Protection Agency <br />Office of the Administrator <br />Environmental Appeals Board (A-101) <br />401 M Street, SW <br />Room 1145 (West Tower) <br />Washington, D.C. 20460 <br />
