Drawer D <br />Hayden, Colorado 81639 <br />Re: Seneca II and Nucla Mines Quarterly Sediment Pond Inspections, <br />Pe~rlit C-80-005 and C-81-008, Respectively. <br />Dean-1~4F-C~e- <br />We have reviewed the First Quarter, 1988 inspection reports and our previous <br />comment letter of January 26, 1988. Below are some concerns we have, based <br />upon this review. <br />Point 2 of our January 26, 1988 letter pertained to the need for Peabody <br />to insure non-clogging dewatering devices are installed on the various <br />discharge point of ponds 001, 002, 004, 005, and 006 at Nucla. The basis <br />for this is that the approved designs requiring non-clogging dewatering <br />devices. A review of the March 16, 1988 inspection reports indicates <br />that trash racks or non-clogging dewatering devices have not been <br />installed on the principal spillways of ponds 002, 004, 005 and 006. <br />Since Peabody was previously notified of this requirement, the Division <br />will take an enforcement action during the April, 1988 inspection if the <br />trash racks or non-clogging dewatering devices are not installed on all <br />of the ponds requiring these devices. <br />The inspection report for pond 003 at Nucla specifies that this will he <br />the last inspection since the Division granted a variance during Permit <br />Revision No. 1. A review of Volume 3, Pages 7-86; Volume 3, Appendix <br />7-1, Page 7-1-9; and the Findings Document of April 2, 1987, pages 11 and <br />12 does not support this claim. The variance that was granted pertained <br />to the design requirements of Rule 4.05.6 based upon the exemptions <br />allowed under Rule 4.05.2(31. No variance was granted from the need to <br />perform quarterly sediment pond inspections since pond 003 is a ponding <br />structure.
