PERIL7IT, PART <br />Page Ih of 13 <br />['emit No. CO-0032G3S <br />(g) Srxmtaneous Disannearance <br />If toxicity spontaneously disappears at any time after a lest failure, the permiltee shall notify the Division in writing <br />within 14 days of a demonstration of disappearance of the toxicity. The Division may require the permittee to <br />develop and submit additional information which may include, but is not limited to, the raults of additional testing: <br />[f no pattern of toxicity is identified or recumng toxicity is not identified, Ute toxicity incident response is <br />considered closed and normal WEf testing shall resume. <br />(h) Toxicity Reopener <br />This permit may be reopened and modified (following proper administrative procedures) to include new compliance <br />dates, additional or modified numerical permit limitations, a new or different compliance schedule, a change in Ute <br />whole eftlttent toxicity testing Protocol, or any other conditions related to the control of toxicants if one or moro of <br />the following events oowr <br />(i) Toxicity has barn demonstrated in the efflttmt and the permit does not contain a toxicity limitation. <br />(u) The PTI/I'IE results indinte that the toxiant (e) represent pollutant(s) that may be controlled with specific <br />numerical limits, and the permit issuing authority agrees that the numerical controls are the most <br />appropriate course of action. <br />(iii) The PTIfC[& reveals other unique conditions or characteristic which. in tha opinion of the permit is~ting <br />authority, justify the incorporation of unanticipated special conditions in the permit. <br />(iv) The Division may reopen this permit cad impose chronic toxicity limits where chronic toxicity is identified. <br />
