Such facilities rare required to have <br />applied for a permit to discharge stormwater associated with nuning activity on or before October 7, 7992. <br />The Division has no record of receipt oja stormwater discharge permit application for the Pittsburg and <br />Mu7NSZy Coal Mining Co. at this time. Stormtvater permitting issues for this facility will be handled separately <br />by the Division's S[ormwater Unit, although this permit may be reopened at a later date to incorporate <br />stormwater provisions, if deemed appropriate. <br />8. Economic Reasonableness Evaluation: Section 25-8-503(8) of the revised (June 198SJ Cofarado Water Quality <br />Control Act required the Division to Auermine whuher or nor any or all of the water quality standard based <br />effluent limitations are reasonably related to the ecanom7c, environmental, public health and energy impacts to <br />the public and affected persons, and are m furtherance of the policies set forth in sections 25.8-192 and <br />25-8-104. <br />77u Regulations for the State Discharge Perrrut System, 6.1.0, further define this requirement under 6.12.0 <br />and state: 'Where economic, environntemal, public heahh and energy impacts to the public and affected <br />persons have beat considered in the class fuatiotts and standards setting process, permits written to meet the <br />standards may be presumed to have taken into consideration economic factors unless: <br />aJ Anew permit is issued where the discharge was not in uistetu:e at the time of the class fu:ation and <br />standards rufentaldng, or <br />bJ In the case of a continuing discharge, additional information or factors have emerged that were nor <br />anticipated or considered at the time of the class fication and standards rulernaldng. <br />77te evaltuuion for this perm7r shows that the Water Quality Control Commission, during their proceedings to <br />adopt the Clans fkation and Numeric Standards for the Lower Colorado River Basin, considered economic <br />reasonableness. <br />Funhermare, this is nor a new discJtarger and rto new information has been preserved regarding the <br />class~ations and standards. 7herefort, the wafer quality standard-based effluent limitations of this permit <br />are determined to be reasonably related to the economic, environnumal, public health and energy impacts ro <br />the public and affected persons and art in furtherance of the policies su forth in Sections ISM-!02 and 104. <br />If the perminee disagrees with this finding, pursuant to 6.12.0(2J(bJ the permiaee should submit all pertinent <br />injormatioti to the Division during the public notice period. <br />
