Purpose of Public Notice: This notice states the intent of the WQCD to petition for the <br />imposition of a negotiated civil penalty against the University of Colorado at Boulder ("CU"). <br />The penalty consists of an $8,500 amount to be offset up to $2,500 of the penalty at a rate of <br />$2.00 of Supplemental Environmental Project ("SEP") cost per $1.00 of the penalty. The <br />remaining cash amount will be paid to the State General Fund. This penalty is sought pursuant to <br />the Water Quality Control Act, § 25-8-608, C.R.S. as alleged in the Compliance Order on <br />Consent to be issued by the WQCD and the DOW. <br />CU owns and operates Williams Village Power Plant which is located in Boulder County, <br />Colorado and is unauthorized to discharge wastewater into Beaz Canyon Creek. <br />Tentative Determination: State tentative determinations have been made in conjunction with the U.S. EPA <br />that limitations and conditions imposed in these permits implement all applicable statutes and regulations <br />and water quality standards. <br />Public Meetipes: Permit Actiop: Pursuant to 25-8-502(3)(b), by March 6, 2000, interested persons may <br />submit a written request for a public meeting on the tentative determination. The Division, after <br />considering all requests, may grant a public meeting for good cause shown. It will be held within sixty <br />(60) days of the date of public notice. <br />Public Comments: Permit Actions: Pursuant to 25-8-502(3)(c) interested persons may submit written <br />comments on the tentative determination provided they aze received by the Division by March 6. 2000. <br />All comments received prior to said date will be considered in the formulation of final conditions and <br />limitations. If a public meeting is held, the public comment period shall close sixty (60) days following the <br />public notice. <br />Following the public comment period and the public meeting, if one is held, the Department will issue or <br />deny the final permit. Interested parties then have thirty (30) days [o request an adjudicatory hearing on the <br />permit. <br />Mailine Address: Public comments should be directed to the CDPHE, WQCD-P-B2, 4300 Cherry <br />Creek Drive South, Denver, Colorado 80246. <br />Further Informatiop: Permit Actions: The draft permit is available for inspection at your County <br />Commissioner's Office and County Health Deparment, or can be obtained by writing [o the Division at <br />the above address and paying a small charge per page for copying fees. <br />Material Iniurv to Water Riehts: In accordance with C.R.S. 25-8-104 (2) (d) (1989), any person who <br />believes that any actions proposed in this notice have the potential to cause material injury to a water right <br />is advised to contact the Division, in writing by March 6. 2000.
