All 16 shares (4 private rights) are documented on RRLC share <br />certificate no. 1916, reissued on April 21, 2003. Historical use analyses have not been conducted forany <br />of the subject private rights to establish their historical consumptive use, firm (usually dry-year) yield, and <br />return flow patterns. Therefore, as the applicant has been advised previously and as detailed in the <br />conditions of approval herein, such analyses must be submitted with the next plan renewal request. For <br />this plan year only, the consumptive use associated with all of these shares was assumed to be 50%. <br />This was based upon average-year site-specific (as opposed to ditch-wide) analyses performed for other <br />parties' RRLC shares in Division 1 Water Court case nos. 90CW181 and 91CW066. This also means <br />50% of the delivered water constituted historical return flows, which must be maintained. Return flows <br />from the Brunelli property were lagged back to the stream using Glover techniques and an SDF of 450 <br />days and return flows from the Roth property were lagged back to the stream using an SDF of 120 days. <br />Riverside Reservoir is not currently able to release directly to the South Platte river, therefore, the <br />RRLC water is obtained through the Weldon Valley Ditch by exchange. However, RRLC plans to rework <br />the outlet on Riverside to enable direct discharge to the South Platte River, possibly by 2004. <br />Bythe original 2003 WaterOrder, Dom Ready Mix released 1.5 RRLC private rights. Though the <br />RRLC direct flow rights average a delivery of 16 AF/private right, this wateryeartheyyielded 15 AF/private <br />right. The water commissioner released these, by exchange, over the course of the irrigation season. <br />Pending availability of annual diversion records, the pattern of release was estimated to follow that of <br />Weldon Valley Ditch diversions. Since no recharge credits were available to replace winter depletions, the <br />applicant ordered a bulk release of the remaining 2.5 private rights, yielding 37.5 acre-feet of direct flow <br />reservoir water, in October 2003. <br />The recharge credits can vary greatly from year to year depending upon the amount of water <br />available for diversion at the recharge structures and the amount required by the participating <br />augmentation plans, which have priority overthe RRLC private rights holders. Forthe period of coverage <br />for this plan, unofficial best estimates from Don Chapman, RRLC Superintendent, indicated that the pro <br />rata share of recharge credits allocated for4.0 RRLC private rights total 2.17 acre-feet (final values will be <br />tabulated and reported by RRLC). The monthly deliveries of the recharge credits are shown in the <br />attached table. For the winter months of late 2003 to 2004, no recharge credits were available. <br />hereby approve this substitute water supply plan in accordance with §37-90-137(11), C.R.S., subject <br />to the following conditions: <br />1. Unless otherwise revoked or modified, this plan shall be valid through May 31, 2004. <br />2. If this plan will not be made absolute by a water court action by the plan's expiration date, a renewal <br />request must be submitted to this office with the statutoryfee (currently $217) no laterthan April 15, <br />2004. <br />
