Special Notifications - Definitions <br />• PART II <br />Page I6 <br />Permit No. COG-850000 <br />a) Bypass: The intentional diversion o[ waste streams from anv_ <br />portion of a treatment facilic~. <br />b) Severe Property Damage; Substantial ph;~sical damage to property <br />at the treatment facilities which causes them co become <br />inoperable, or substantial and permanent loss of natural <br />resources which can reasonabl•i be expected co occur in the <br />absence of a bypass. Ic does not mean economic loss caused by <br />delays in production. <br />c) Spi11: An uninceneional release of solid or liquid material <br />which may cause pollution of state waters. <br />d) Upset; 2_n exceptional incident in which there is unintenciorai <br />and temporary noncompliance with permit effluent limitations <br />because of factors be•fond the reasonable control of the <br />permittee. An up sec does not include noncompliance co the extant <br />caused by operational error, improperly designed treatment <br />facilities, inadequate treatment facilities, Lack of preventac:~e <br />maintenance, or careless or improper operation. <br />3, Noncomoliarce Notification <br />a} If, for any reason, the permictee does not comply with or wil'_ be <br />unable to comply with any discharge limitations or standards <br />specified in Ch is permit, the permittee shall, at a miniaum, <br />provide the Water Quality Control Division and EPA with the <br />following infor:nac'_on ac the time Discharge Monitoring Reports <br />are submitted: <br />(i) A description of the discharge and cause of noncompliance: <br />(ii) The period of noncompliance, including exact dates and <br />times and/or the anticipated time when the discharge •.rill <br />return co compliance; and <br />__i) Steps Being _aken to reduce, e1_vinaca, and prever.c <br />recurrence of the noncomoLving ..ischarge. <br />
