Carpenter: <br />This office has received a number of complaints that runoff water from <br />r_he Snowstorm Site of M & Pi Mining Company has been discharged into the <br />Piiddle Fork of the South Platte River. The discharge was reported co <br />have occurred between Friday, August 11, 1989 and Pfonday, August 14, 1989. <br />As this facility does r.ot have a CDPS permit as required by 25-8-501(1) <br />Colorado kevised Statutes, this discharge represents possible "Criminal <br />pollution of State waters" as defined by 25-8-609 Colorado Revised <br />Statutes and would be subject to the penalties described under that <br />section of the law. Also, as the company did not report the violation, <br />Sectio^ 25-8-601(2) would have also been violated. I am enclosing a copy <br />of these sections of Colorado Revised Statutes (Colorado Water Quality <br />Act) for your reference. <br />I did not actually see the discharge reaching the river during my <br />znvestigatien of the incident. on August 14, 1989. However, a large <br />amount of highly turbid runoff water from the facility was flowing under <br />Colorado Highway 9. A large portion of this runoff had flowed through <br />the catch basin toward the river. Tne turbid condition of the river <br />downstream of the facility indicated that the discharge had previously <br />reached the river. <br />I have been told by several reliable witnesses that they saw the <br />pollutants enter the river. <br />This office is not pursuing formal euforcement action at this time. <br />However, we will pursue enforcement action on any future discharges. <br />
