The <br />discharges were due to pond inflows from recent precipitation events. I noted the possibility that the analytical results might exceed <br />certain primary effluent limitations of CDPS Permit No. CO-0000132 and that a determination of compliance with the permit "alternate <br />limits' might be required. <br />Preliminary lab results (faxed lab data received by OMLLC on 11/1/2006) indicate that, for both outfalls, primary effluent TSS and 30 <br />day average Total Iron standards (014 only) were exceeded but alternate SS standards were met. Thus, OMLLC will be able to <br />demonstrate compliance with the permit "alternate limits." <br />OMLLC will be presenting the information in the October 2006 monthly DMR report to the CDPHE shortly. <br />OMLLC is aware of CDRMS Rule 4.05.13(2) which requires Division notification of noncompliance with surface water permit <br />conditions or standards. While OMLLC does not consider these discharges as a noncompliance event nor subject to the cited <br />CDRMS Rule, we are nevertheless, providing this email as a courtesy notification to CDRMS. <br />Please contact me if you have questions. <br />Jim Kiger <br />OMLLC <br />11 /2!2006 <br />
