Nielsen <br />General Manager <br />American Soda, L.L.P. <br />2717 County Road 215 <br />Parachute, Colorado 81635 <br />RE: UNDERGROUND INJECTION CONTROL (UIC) <br />Class III Solutioa Miniag Well <br />Fiaal Area Permit <br />EPA Area Permit C03858-00000 <br />Rio Blanco County, Colorado <br />Dear Mr. Nielsen: <br />The Environmental Protection Agency (EPA) has reviewed the <br />comments received on the Draft Permit for the Yankee Gulch Class <br />III Sodium Minerals Project. The agency hae determined that the <br />Permit for the Yankee Gulch Project can be issued with some <br />modifications. EPA has prepared an Addendum to the Statement of <br />Basis and Response to Comments (Addendum). This Addendum <br />outlines the Regions rationale for modifying the Permit. It <br />also provides clarification with regards to the comments made <br />during the public comment period. The Final Class III Solution <br />Mining Well Area Permit for the construction and operation of <br />solution mining wells for the Yankee Gulch Sodium Minerals <br />Project, Rio Blanco County, Colorado is enclosed. Also enclosed <br />is a copy of the Addendum. <br />The EPA procedures for issuing UIC permits are described in <br />the Code of Federal Regulations (CFR) Title 40, Part 124 <br />(40 CFR § 124). These procedures are provided to allow the <br />public to have an opportunity to comment on the proposed Permit <br />action. <br />Please be aware that it is necessary to delay the Effective <br />Date of the Final Permit for an additional thirty (30) days. <br />This delay is required by 40 CFR § 124.15 (b) to allow for <br />potential appeal of the Final Permit decision. <br />Printed on Recycled Paper <br />
