NSI subsequently conducted and submitted manual water level readings to our <br />office in a letter dated September 20, 2006. At the October 12, 2006 monthly <br />coordination/inspectionrneeting Mr. Daggett was informed that the third party contractor has not <br />submitedt the monthly water level data for August and September. At this time Mr. Daggett <br />informed NSI that they are in non compliance with their approved comprehensive monitoring <br />and this letter is a written follow up of the Notice of Noncompliance. The affected wells aze as <br />follows: 89-1, 89-2, 89-3, 90-2, 90-3, 90-4, BG-1, BG-4, DS-2, DS-3, EX-2, IRI-1, IRI-4, IItI-5, <br />IRI-6 and IRI-7. <br />A reliable continuous water level recording/monitoring system is required to be in place and <br />implemented to provide the continuous water level monitoring data in the NSI monthly <br />submitted reports by December 1, 2006. <br />If there any questions, please contact Paul Daggett, Mining Engineer at (303) 878-3819. <br />Sincerely, <br /> <br />Kent E.
