E°ng <br />Division Duecbr <br />29515 Routt County Road #27 <br />Oak Creek, CO 80467 <br />Re: Second Quarter, Third Quarter, and Fourth Quarter 1997 Sediment Pond Inspections, <br />Twentymile Coal Company, The Foidel Creek Mine, Permit No. C-82-056 <br />Dear Mr. Mills: <br />On August 13, 1997, the Division received a letter from Tavis Rogers regarding the 1997 quarterly <br />sediment pond inspections at the Foidel Creek Mine. Specifically, Mr. Rogers requested that the <br />sediment pond inspections reflected in the quarterly report submitted to our office earlier this month <br />be considered for both the second and third quarters of 1997. <br />The Division cannot accept one set of pond inspections for two quarters, as Rule 4.05.6(13) requires <br />ponds be inspected quarterly. We will therefore accept the most recent set of inspection materials <br />for the second quarter of 1997. Please be sure to conduct another set of inspections near, but not <br />after, the end of September 1997. We will consider those as meeting the requirement for the third <br />quarter of 1997.
