<br />The is a request to mine aggregate material from a 47+ acre parcel located 4+miles northeast of <br />Bennett in unincorporated Adams County, Colorado. The 47+ acre azea is part of a lazger 385± <br />acre property owned by the David and Joyce Lincoln. The site is located 4± miles northeast of <br />Bennett, if miles east of SH 79 and 'fz mile south of County Road 72. By road designation, the <br />~ location is the alignment of East 68" Avenue, west of the alignment of Provost Mile Road. By <br />legal description, most of the site is located in the NE I/4 of the SE 1/4 of Section 2, T3S, R63W <br />of the 6'~ P.M., Adams County, Colorado. The site a dry alluvial bank area along the west side <br />Kiowa Creek, but is not within the existing flood plain of Kiowa Creek. The total elevation tall <br />over the distance of the site (1/2+ mile north to south x 1/3f mile east to west) is approximately <br />~ 50 feet. The site is not easily visible from the Counry Road or most of the adjacent property. <br />except for property 1 mile to the east across Kiowa Creek. <br />In 1983 a Mr. Robert Vickroy, permitted an 11+ acre pazcel in the northeast corner of the 385± <br />acre property for sand and gravel mining (49-83-C & M-83-085).In the early 1990's, the Mr. and <br />~ Mrs. Lincoln acquired the property, assumed the MLRB permit, and renewed permission from <br />the Counry to mine the 11+ acres of property (082-92-C) under the name of Bennett Sand and <br />Gravel. Except for continuing revegetation activities, all other mining related activities on the <br />original 11± acres should terminate by the end of 2001. Mr. Lincoln also permitted a shotgun <br />shooting facility on pazt of the 385± acre property, but has since terminated this operation. <br />• <br />The new 47+ acre operation is proposed on the western portion of the 385+ acres. The operation <br />is expected to last from 5 to 10 years, extract 1/2+ million cubic yazds of material, and be mined <br />in 4 phases. The plant on the original 11+ acre mining area will be moved to the northwest <br />corner of Phase 1 of this operation to process material, but material may also be exported directly <br />r for use in foundation backfill projects, and County or CDOT projects in the azea. This will be <br />dry alluvial mining operation with no exposure of ground water. Water for dust control, washing, <br />etc. may be obtained from the Upper Arapahoe well on the original 11 + acre mining operation. <br />Mr. Lincoln may also elect to obtain an additional permit to drill another non-tributary well for <br />this purpose. As with the original operation, the operation will be responsible for dust controls <br />~ on 72°d Avenue to SH79. The operation will also conform to all requirements of Section 11.340 <br />of the Zoning Regulations, except the Planning Director shall be allowed to extend the hours of <br />operation by Temporary Use for projects requiring extended delivery hours. Prior to starting <br />operations, a "Notice to Proceed" will be obtained from the County. <br />~ Mining will proceed from north to south in 4 phases. Phase 1 is 17± acres. The other three phases <br />aze each 10± acres. Although there is little topsoil type material, where some is present, 1'± of <br />the surface material will be stripped and stored along the west portion of each phase. Any <br />overburden in each phase will also be stored in this same azea. In each phase, after the available <br />resources have been mined, maximum 3H to 1V and minimum 2% slopes will be constructed and <br />~ available stored surface material from that phase will be spread for later revegetation. Reclama[ion <br />will consist of seeding with non-irrigated grasses in 5 phases, with the plant site reclamation being <br />the last phase. A permanent private internal 30' private road will also remain along the east side <br />of the permit area. <br />• <br />6 <br />
