Under DMG rules, re-vegetation success is based on achieving cover and diversity equal to
surrounding vegetation. As required at the time of final well reclamation DMG and/or
COGCC would conduct a final inspection of re-vegetation work conducted by RMAT on the
Lower Mine Bench, Lower Bench Road (if needed, see D. above), and any mine permit areas
disturbed by RMAT. Upon demonstrating successful site re-vegetation DMG and COGCC
will release RMAT of obligations to continue monitoring and maintenance of re-vegetation.
No material or wastes may be buried on site with the exception of activities normally
associated with gas drilling operations per COGCC rules and regulations.
Yours truly,
~'~`-
T, Kent Woolley CPL
Senior Landman Advisor
Rocky Mountain Asset Team
Occidental Oil and Gas Corporation
C:\Documents and Settings\woolleyk\Local Settings\Temporary Internet Files\OLKS\Mine bench letter of
assumption to OOSI.doc
