The existing well on the Adams property has a 58-foot easement along Highway 85. This <br />easement is not located on the exhibits and does not appear that there is a buffer from this <br />easement. Please clarify. <br />We are unable to locate the easement that you are questioning. Please refer us to the source of this <br />easement information so that we may research it. <br />45. The applicant assumes a 35-foot easement from the Fulton ditch centerline, or !5 feet from <br />the top of the bank, whichever is greater. Please give an accurate easement location, rather <br />than assume 35 feet from the ditch centerline. <br />Based on our conversation with Fulton Ditch Engineer Colby Hayden, P.E., the Fulton Ditch has a <br />prescriptive easement. The easement is a 35-foot easement from the Fulton ditch centerline or 15 <br />feet from the top of the bank whichever is greater. The only thing associated with the Fulton Ditch is <br />a lateral that runs along Weld County Road, outside of the permit boundary. The Mining Plan Map <br />shows a 40' setback from the property line. The stability analysis (which Allen Sorenson has <br />approved) demonstrates that this setback is adequate to protect the ditch. <br />46. The Div)sion's staff engineer is currently reviewing the stability analysis prepared by Civil <br />Resources, LLC. Any additional questions or comments will be submitted underseparate <br />cover. <br />It is our understanding that the Division has approved the stability analyses (Allen Sorenson, March <br />23, 2005 memorandum). <br />Thank you for your assistance with this application process.
