Exhibit 6 of 7 depicts a gas line and electric line leading to the gas well in pond 2, an electric <br />line in the southwestportion of Pond 2, and an electric line crossing in pond 3 and continuing <br />to the silt basin wetland. Please explain how these structures will beconstructed/supported <br />in the middle of the reclaimed ponds. <br />The gas and electric lines will be removed from the existing well location in the middle of Pond 2 that <br />head west towards Highway 85. This has been corrected on the maps. The line on Exhibit 6 of 7 <br />that is in the southwest comer of Pond 2 and turns to Pond 3 then over the wetland basin is a section <br />line, not an electric line. We have deleted this from the map. <br />28. Please provide additional information regarding the reclamation of the wetland areas on site. <br />In particular, please state the final reclaimed slopes, depth of topsoil to be replaced and the <br />seed mixture fo be utilized. <br />Due to the need for silt material storage and the depth to groundwater, all settling ponds will be filled <br />and reclaimed as upland. The enclosed Reclamation Plan Maps have revised to show this change. <br />29. Please locate all roads that will remain on site as a component of the reclamation plan. <br />Locate the roads on the reclamation plan map and include (heir composition and dimensions. <br />The Reclamation Plan Map shows the reservoir maintenance roads that will remain on-site as a <br />component of the reclamation plan. All other roads used for the mining operation will be demolished <br />in creation of the reservoir, or reclaimed to upland. <br />30. !n Exhibit E, the applicant states that the operator will comply with the reclamation measures <br />set forth in Section 3.1.5. Please describe in further detail as to how the applicant will compty <br />with these requirements at the Lupton Lakes site. <br />The Operator will comply with the reclamation measures set forth in Section 3.1.5: <br />• Grading will create a final topography that is appropriate for the water storage reservoirs. <br />• Grading will be performed to help control erosion and siltation of the affected lands <br />through phased mining, concurrent reclamation and siltation fences where appropriate <br />and necessary. <br />^ Backfilling and grading shall be completed as soon as feasible after the mining process <br />is complete. <br />^ Drill or auger holes that are part of the mining operation shall be plugged with non- <br />combustiblematerial, which shall prevent harmful or polluting drainage. <br />• Maximum slopes and slope combinations will be compatible with the configuration of <br />surrounding conditions and selected land use. All slopes will be compatible with <br />specified MLRB standards and Office of the State Engineer standards. <br />• Mined material to be disposed of within the affected area will be handled in such a <br />manner so as to prevent any unauthorized release of pollutants to the surface drainage <br />system. No unauthorized release of pollutants to groundwater will occur from any <br />materials mined, handled or disposed of within the permit area. <br />• The Operator will comply with applicable Colorado water laws governing injury to <br />existing water rights and with applicable state and federal water quality and dredge and <br />fill laws and regulations.
