Clayton Construction Co. "FILED" an <br />=_pplication,a reclamation plan and nap, and the required fee, as required by law; and <br />!~iHEREAS, onJanuary 23 19 80, the `lined Land Reclamation Board approved <br />Clayton Construction Co. application and sec bond; and <br />WHEREAS, onJanuary 23 1980, the `fined Land Reclamation Board accented <br />surety submitted by Clayton Construction Co. and such date shall be considered the <br />dat~.aE issuance of the permit and the anniversary date Eor all ocher purposes; and <br />5+1iEREAS, the ?fined Land Reclamation Board has made a finding, for the purposes <br />of issuing this permit, that: <br />1) the application complies caith the requirements of the Colorado <br />Kined Land Reclamation Act and all applicable local, state and <br />Federal laws; and, <br />?) the operation will not ad:•ersely affect the stability of wry <br />significant, valuable, and permanent a+an-made structures Located <br />within tc+o hundred fget of the affected land, e:<cept :where there <br />is ar. agreement between the operator and the persons having an <br />interest in the structure that damage to the structure is to be <br />comrensated for by the operator; and, <br />3) the proposed mining operations and reclamation can be carried ou*_ <br />in conformance with the reeuirements of C.R.S. 1973, 34-32-i15, as <br />amended (1976 Sess. Laws H.B. 1065); and <br />GIHEREAS, Eor the purposes of issuing this nernit, the operator has made a <br />satisfactory showing to the Board chat he will employ dur'_ng and after his open <br />mini..^,g eperations procedures reasonably designee to minimize <br />as much as practicable *_he disruption from the open miring operations <br />and will provide for the rehabilitation of the affected land through the rehabilitation. <br />of plant cover, soil stabilit water resources, and other measures appropriate to tae <br />subsequent beneficial use of such mined and reclaimed lands; and that in the event <br />of the Failure of his proposed ceclamation plan, ha will take whatever measures which <br />may be necessary in order to assure the success of reclamation of the lands affected <br />by his open mining operations; and, <br />'.~dEP.EAS, for the purposes of issuing this permit, a copy of the application <br />approved by the :"_ined Land Reclamation Board of the State of Colorado is attached <br />to this permit and [:Hereby becomes a part of the tarns hereof. <br />SCW, THERE?'ORE, pursuant to the authority set forth in the Colorado ".iced <br />Land Reclamation :1ct, Article 32 of Title 3L, C.R.S. 19i3, as amended, (19.6 <br />Sess.
