Lochhead <br />Execmive Director <br />MichaelB Long <br />Division Di~ecbr <br />I have received the responses to my first adequacy letter, contained in a packet from your agent, <br />Robert Larson, dated October 24, 1997. Though I have not reviewed the entire response yet, I <br />noted that it involved an increase in acreage, from 2.44 to 3.19 acres. <br />Construction Materials Rule 1.1(6) defines an amendment as a change in an application which <br />increases the acreage of the affected land. This last submittal is, therefore, an amendment to your <br />application. Rule 1.6.6 states that ifthe application is amended, the applicant must republish and <br />remail the public notice (even if none of the terms contained in the notice are affected by the <br />change), and the 30-day review time will begin again. <br />Rule ].8.1 requires that the applicant place the amended application on file with the county clerk <br />and recorder, and provide proofofthat filing to this office. Rule 1.8.2 also mentions the extended <br />decision date, in the context of allowing additional time for government offices and the public to <br />review and comment on the amended file. I am assuming that tl3e faxed material this office <br />received constituted the complete and correct amended filing, and a copy was made by this office <br />and sent to the Division's Denver office. You will be notified of the formal extension to the <br />decision date by letter directly from the Denver office. <br />If you have questions, please feel free to contact me at 970/247-5193.
