Kiger <br />Colowyo Coal Company <br />5731 State Highway 13 <br />Meeker, Colorado 81641 <br />RE: Request for Alternate Limits Due to Snowmelt <br />CDPS Permit No.: CO-0045161; Outfall OlOA <br />Moffat County <br />Deaz Mr. Kiger: <br />This letter is in response to your letter's dated Apri126 and June 3, 1999, in which you provided <br />information regazding a snowmelt event that occurred during the week of February 23, 1999. In <br />your letters, you claimed: 1) that the pond, Outfa11010A, contained a volume of less than two and <br />one half (2.5) acre feet 2) The total pond volume below the emergency spillway invert was <br />approximately nine (9) acre feet 3) outfa110] OB was not dischazging during this event; and (4) that <br />temperatures were rising throughout the week thus increasing snowmelt in the azea. The self <br />monitoring data you provided on your first quarter Dischazge Monitoring Report is shown below: <br />utfall Pazameter Results Permit Limits <br />OlOA .TSS (mg/1) 40 (35 day avg) 30 (35 day avg) <br />O1 OA Iron, Total (mg/1) 8.35 (30 day avg) 3.5 (30 day avg) <br />OlOA Iron, Total (mg/1) 8.35 (daily trix) 7.0 (daily mx) <br />Coloywo has demonstrated that dischazge occurred within 48 hours after measurable snowmelt, <br />dischazge was beyond your control and that the required pond volume for a storm event was <br />available. We believe that Coloywo qualifies for the alternate limits of a less than or equal to 10- <br />yeaz/24-hour precipitation event, thus waiving TSS and Total Iron limits. <br />
