_~•- <br />MLR/CP-MO-5/77 <br />In The Matter Of <br />• <br />MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />MATHIAS CONCRETE <br /> <br />• ~IIII~II~II~I'~~II~ <br />C O N S E N T A G R E E M E N T <br />------- --------- <br />Pursuant to the Resolution Concerning Compliance Plans for Unpermitted <br />Operations adopted by the Mined Land Reclamation Board on February 22, 1977 <br />the Board and M.yTHIAS CONCRETE hereby enter into the following <br />agreement: <br />In consideration of MATHIAS CONCRETE 's compliance with <br />the requirements of the above-cited resolution and the cease and desist order <br />issued thereunder, the Board hereby agrees to afford to MATHIAS CONCRETE <br />the benefits of the above-cited resolution. <br />In consideration of the benefits conferred by the above-cited resolution <br />MATHIAS CONCRETE hereby consents to the following conditions: <br />1. Submittal of a permit application or reclamation plan as required by <br />the Procedural Requirements contained in the Mined Land Reclamation Board's <br />Resolution of 4/18/77, for each of the operations indicated on the list sub- <br />witted to the Board on May 24, 1977 in accordance with the <br />following schedule. <br />t7 h 2 <br />Feet two operations on or before July 1, 1977 <br />2. If the Board denies the permit for any of these operations, then <br />those operations denied permits shall cease as of the date of the denial. <br />3. If permits are not granted for any of these operations by July 1, <br />1978, cease those unpermitted operations unless the time period for the granting <br />of the permits is further extended by Board resolution. <br />4. Be bound by the terms of the cease and desist order issued by the <br />Board on June 1, 1977 for these operations. <br />
