IIAI,L <br />Planning Department No. C36-83 <br />WHEREAS, W.R. and W.T. }call sought to obtain a condi- <br />tional use permit fnr gravel extraction in the AFT Zone on the <br />following described land situated in the County of Mesa, State <br />of Colorado, to-wit: <br />That part of the SW'~SE!s and S!iSWIy lying <br />South and East of the Orchard Mesa Canal No. <br />2, in Section 26, Township 1 South, Range 1 <br />East of the U[e Meridian; together with an <br />easement for access over and across the South <br />40 feet of that part of the SW!c5[J!y of said <br />Section 2G, extending from the Wes[ boundary <br />line of the said SW%SWZ (being 32 Road), Eas[ <br />[o the West boundary line of the above described <br />property. This easement may at [he discretion <br />of the grantors, be used by others; it may not <br />be shaced or conveyed by grantees, except to <br />their successors in title, or grantees, <br />licensees or invitees. The restriction upon <br />grantees [o share or convey said easement, as <br />above defined, shall be void upon the grantors <br />r_onveying title to the said SWItSWIt to any third <br />party or parties. <br />and, <br />WHEREAS, the hearing before the Board of County <br />Commissioners of the County of Mesa was held. <br />WHEREAS, the Board considered [he evidence presented <br />at the hearing and the zoning maps and regulations of the County <br />and FINDS: <br />1) That the hearing was duly held after proper notice. <br />2) That [he Mesa County Planning Commission <br />recommended approval of the conditional use subject to staff <br />comments. <br />3) That [he Planning Staff recommended approval <br />subject to: <br />(a) Paving the haul road from [he Orchard Ptesa <br />IrrigaCion Canal to 32 Road. <br /> <br />~ <„W7re+ie <br />r <br />
