of riparian areas, which the field inspections indicated no potential problems for <br /> compliance. On this basis, CEC feels that a formal wetlands inventory to determine <br /> whether a 404 permit is required (which is the only reason that the USFWS made the <br /> suggestion) is redundant, as both CEC and the BLM have agreed to the stipulation <br /> which effectively keeps the drilling sites from disturbing areas potentially requiring a <br /> 404 permit. Lastly, the CDOH dewatering permit (which has been applied for per our <br /> previous discussion) will address the discharge of water from the drill sites. On the <br /> basis of these items, CEC feels that further wetlands identification on the initial seven <br /> sites is not required, and that the site inspections by BLM next spring for subsequent <br /> locations will more than suffice to address the USFWS suggestion. <br /> CEC does wish to clarify the status of hole PEDS-25. This hole still requires a final <br /> landowner agreement and the approval of an access across Section 16, in addition to <br /> the second notice period as previously indicated. CEC apologizes for any confusion <br /> on this matter, as we thought that we had received the final landowner agreement for <br /> this site since it had been moved to the west a short distance. A copy of the <br /> landowner agreement for this site will be forwarded to the Division upon receipt, and <br /> prior to initiation of any site prep. <br /> A bond in the amount of $244,000.00 to cover the abandonment and reclamation costs <br /> was hand delivered to the Division on Thursday, along with a copy of the Exploration <br /> License bearing the Cyprus signature. A copy bearing the BLM signature and the <br /> Cyprus signature is included with this package. As noted in my discussion with Ms. <br /> Binns Thursday, there are no changes between the two documents. <br /> As discussed, the State Engineer's Office has been notified, and monitoring wells <br /> installed under this program will be registered within one year as neccessary. <br /> A construction dewatering permit application for the discharge of water encountered <br /> during the drilling process has been submitted to CDOH, and is pending. As <br /> discussed, water flows will be handled by means of the mud pits or a vac truck until <br /> such time as the dewatering permit is issued. <br /> Barbara, your assistance has been greatly appreciated.
