<br />September 19, 2001 <br />Page 3 of 3 Pages <br />The Rail Loop Pond (Outfa11006A) <br />As reported, this pond was not in a good state of repair. <br />The approved design is found in Exhibit 7, Tab 13, Appendix F, 04-17-1998 of the Division <br />permit. The bottom of the pond is at an elevation of 6344.15 feet. The approved design is for <br />0.02 acre feet of sediment storage at a top of sediment storage level of 6344.98 feet. By reference <br />2) above, Colowyo Coal Company, L.P. (Colowyo) reports that there was approximately 5 feet <br />of sediment in the pond on June 10, 2001. This level of sediment equates to an elevation of 6349, <br />or approximately four feet higher than the design maximum. Reference 2) goes on to report a <br />current capacity of the pond to contain 0.3214 acre-feet of water prior to dischazging. This is the <br />storage capacity between the level of the S foot of sediment and the lowest dewatering hole of <br />the primary spillway riser. The water storage design capacity is 0.94 acre feet. <br />There appeared to be a level of water, frozen or with snow cover, in this pond in an aerial <br />photograph (aerial inspection) taken on Januazy 9, 2001. There was an estimated discharge of <br />0.03 cubic feet per second discharge from this pond at the time of a Division inspection of <br />February 20, 2001. There was water in, but no discharge from, this pond at the time of a Mazch <br />21, 2001 Division inspection. There was a little water in this pond but no discharge at the time of <br />the September 12, 2001 inspection. This pond has been cleaned.
