John P. Slovek, Sr., John P. Slovek, Jr., Gary W. <br />Slovek, and Michael S. Slovek, who are the owners of approximately twenty-two <br />acres of real property adjacent to and north of the property affected by the subject <br />application, object to the granting of a permit on the following grounds. <br />Rule 1 .57 of the Rules and Regulations of The Colorado Mined Land Reclamation Board <br />provides that: <br />"No permit for new mining operations shall be granted to any operator <br />who is currently found to be in violation of the provision of this article <br />with respect to any operation in this state". <br />Weld County was operating without a permit as is evidenced by this ward's findings of <br />July 24, 1980, and rendering of a civil penalty. <br />Rule 1 .56 (8) requires a applicant's reclamation plan to meet certain requirements. The <br />reclamation plan of Weld County fails as is evidenced by [he attached hydrologist's report. <br />Rule 1.56 (5) requires denial of a permit if structures within 200 feet of the operation may <br />be adversely affected by the operation.
