During July of 1986, while portal site selection questions had not <br />~• been resolved, the East Roatcap Creek area was still considered to be a <br />strong candidate for siting of the portal. Colorado Westmoreland was <br />informed by its consultant, Centuries Research and the SIM, that it <br />might be necessary to formally evaluate 5DT271 as part of the Section <br />106 process if the portal was sited near it. If this was to happen, <br />unavoidable delays in the granting of construction permits might occur. <br />It was, however, believed by all concerned parties that if the site <br />' received full evaluation as soon as possible, the risk of such delays <br />might be minimized, If, however, an evaluation wire not begun until <br />after the final selection of the portal location, then delays could <br />probably not be avoided. Colorado Westmoreland was anticipating <br />approval of its construction permits by November, 1986. The evaluation <br />program at SDT271 was expected to take at least tvx~ weeks. Preparation <br />of the project report was expected to take at least one tronth. Gnly by <br />' starting the evaluation program by early Auqust could the time schedule <br />of November 1, 1986 be realized. <br />t 'ihst excavations were subsequently conducted at 517P271 during <br />August of 1986. By the end of August a portal site was selected on Fast <br /> Roatcap Creek. The revised area of undertaking was established as a <br /> maximtutt 20 acre parcel (Figure 2). The nearest boundary of this area is <br />t 600 feet north of 5DT271. Rice the final portal site selection was <br /> trade and construction plans developed, it was possible for the BLM to <br /> deternune that 5DT271 was outside of the revised area of undertaking and <br /> that it would not be impacted by development of the portal. For these <br />' reasons, it was not necessary for the BLM to initiate the Section 106 <br />. process of the National Historic Preservation Act. <br />t Nevertheless, Colorado Westrroreland had undertaken a substantial <br /> and productive excavation program at SIYI'271. While a final site <br /> evaluation report is no longer thought to be necessary in regard to <br />' processing of various permit applications for construction of the nea <br /> portal, it was thought to be appropriate to inform the BIM, SHPO and OSM <br /> of the extent, nature and findings of the excavations. There is also an <br /> obligation on the part of Centuries Research to provide an initial <br />' report on the work conducted at 5DT271 under provision of BIM <br /> Antiquities Permit C-40159c which expires on December 31, 1986.
