r <br />GRAVEL LEAS <br />AGREEMENT, made and entered into this~g~day of May, 1977, by and <br />between Kirk Alexander and Kathleen L, Alexander whose address is Norwood, <br />Colorado, hereinafter referred to as Owner, and Nielsons, Inc. of Cortez, <br />Colorado, hereinafter referred to as Nielsons. <br />WITNESSETH: <br />THAT IVHEREAS Nielsons, Inc. desires to obtain construction materials <br />of satisfactory quality and quantity for use in construction, which material <br />is available from land owned by the Owner and described as follows: <br />TO WIT: <br />Section 31, Township 43N, Range 9 West N. M.P,M. <br />NOW THEREFORE: <br />IT IS AGREED BY THE PARTIES HERETO: THE OWNER, for the consideration <br />of One Dollar ($1.00), receipt of which is hereby acknowledged, hereby <br />grants to Nielsons the exclusive right and option from the date of this <br />Agreement until the 1st. day of December, 1977, at 12:00 Noon to purchase <br />and remove from the subject premises. Nielsons, Inc. will pay royalty <br />payments due by the fifteenth (15th) of the following month for materials <br />used and sold during the preceeding month. <br />AI I types of construction aggregates at forty cents C$.40) per ton. <br />NIELSONS shall then have the exclusive right to purchase and remove <br />any and all construction materials. <br />NIELSONS shall have the right to ingress and egress to and from the <br />subject premises and erect any temporary structures and employ any reasonable <br />methods for the removal of said material. After Nielsons has completed it's <br />removal operations, it will leave the premises in a neat condition. <br />THE OWNER hereby warrants that he has good title to the above described <br />premises; that he has the lawful right to grant this Option; and that he <br />agrees to hold Nielsons free and harmless from any and all claims from others <br />asserting any interest in the subject land. <br />ADDITIONAL CONDITIONS: <br />In the event that the Colorado Division of Highways becomes desirous <br />of purchasing gravel from the above described property an agreement will <br />be made subject to approval of Nielsons, Inc. and the Property Owner for <br />such material as needed. <br />NIELSONS, INC. <br />BY:~ <br />J.
