PART II Page No. 38 Permit No.: CO-0002 4. Noncompliance Notification i a. If, for any reason, the permit[ee does not comply with or will be unable [o co[~nply with any discharge limitations or standards specified in this permit, the permittee sha0, at a minimum, provide the Division and EPA with the following information: i) A description of the discharge and cause of noncompliance; ii) The period of noncompliance, including exact dates and times and/or the anticipated time when the discharge will return to compliance; and iii) Steps being taken to reduce, eliminate, and prevent recurrence of the non~:omplying discharge. i b. The permittee shall report the following circumstances orally within twenty-four (24) hours from [he time the petmittee becomes aware of the circumstances, and shall mail to the Division a written rieport containing the information requested in Part ILA.4 (a) within five (5) days after becoming aware of [he following orrcumstances: i) Circumstances leading to any noncompliance which may endanger healthior the environment regardless of the cause of the incident; ii) Circumstances leading m any unanticipated bypass which exceeds any effluent limitations in the permit; iii) Circumstances leading [o any upset or spill which causes an exceedance of any effluent limitation in the permit; iv) Daily maximum violations fo: any of the pollutants limited by Part LA of this permit and specified as requiring 24- hour notification. This includes any toxic pollutant or hazardous substance or any pollutant specifically identified as the method to control any toxic pollutant or hazardous substance. c. The permittee shall report instances ofnon-compliance which aze not required, [o be reported within 24-hours at the ti Discharge Monitoring Reports are submitted. The reports shall contain the information listed in sub-paragraph (a) of~ section. ~. Other Notification Requirements Reports of compliance or noncompliance with, or any progress reports on, interim :md final requirements contained in any compliance schedule in the permit shall be submitted no later than fourteen (14) da~s following each scheduled date, unless otherwise provided by the Division. The permi[tee shall notify the Division, in writing, thirty (30) days in advance of a proposed vansfer of permit as provided in Part II.B.3. The permittee's notification of all anticipated noncompliance does not stay any permit condition. All existing manufacturing, conmrercial, mining, and silvicultural dischargers must notify the Division as soon as they know or have reason to believe: a. That any activity has occurred or will occur which would result in the discharge„ on a routine or frequent basis, of any toxic pollutant which is not limi2d in the permit, if that discharge will exceed the highest of the following "notification levels": i) One hundred micrograms per liter (]00 ug/1); ii) Two hundred micrograms per liter (200 ug/1) for acrolein and acrylonitrile; five hundred micrograms per liter (500 ugd) for 2.4-dinitrophenol and 2-methyl-4.6-dinitrophenol; and one milligram per liter (LO mg/I) for antimony; iii) Five (~) times the maximum concentration value reported for that pollutant in the permit application in accordance with Section 61.4(2)(8). iv) The level established by the Division in accordance with 40 CFR 5 122.44(f). b. That any activity has occurred or will occur which would result in any discharge:, on anon-routine or infrequent basis, a toxic polhttant which is not limited ut the permit, if that discharge will exceed the highest of the following "notification Levels": i) Five hundred micrograms per liter (500 ug/I); ii) One milligram per liter (I mg/I) for antimony; and iii) Ten (10) times the maxinuun concentration value reported For that in the permit application.
