The pennittee must, by December 31, 2008, submit a progress report summarizing the efforts undertaken by the <br />permittee for a site specific limitation for total recoverable iron, in regards to the WQCC hearing for the Upper <br />Colorado River Basin, as well as the WQCC decision from the rulemakit~ig hearing in hme 2008. <br />iii. The petmittee must, by September 30, 2008, s Submit to the Division ar} amendment request for either updating the <br />limitation for total recoverable iron based upon a site specific standard (if approved by the WQCC), or for additional <br />time to meet the limitation which cun~ntly takes effect on January I, 20019. <br />Upon approval of the implementation plan by [he Division, all tetras and conditions of the implemen[atioa plan, including <br />but not limited to [he compliance schedule, will automatically become conditions of this permit. <br />6. Chronic WF.T Testiue -- Outfalls WTA ,WTB, WTC, WTD, WTE, WTF, WTG, WTH, WTI <br />a. Testing and Reporting Requirements <br />Tests shall be done at the frequeney listed in Part LB1. Test results shat] be reported on the Discharge Monitoring <br />Report (DMR) submitted for the reporting period during which the sample was taken. (i.e., WET testing results for the <br />first calendar quarter ending March 31 shall be reported with the DMR due April 28J The results shall be submitted on <br />the Chronic Toxicity Test report form, available from the Division. Copies of these reports are to be submitted [o both <br />the Division and EPA along with the DMR. <br />The petmittee shall conduct each chronic WET test in general accordance with methods described Short Term Methods <br />for Estimating the Chronic Toxicity of Effluents and Receiving Waters to Freshwater Oreanisms, EPA/600/4-89/001 or <br />[he most current edition, except as modified by the most current Division guidance document entitled Guidelines for <br />Conducting Whole Effluent Toxicity Tests. The permittee shall conduct such tests using Ceriodaphnia dubia and fathr2 <br />minnows. <br />Alternative Tesi Method As the discharges from this facility are occasionally "intermittent discharges", an alternative <br />utethod for sample collection during WET testing maybe needed. The permi'ttee shall collect all needed samples (3) for <br />WET testing on the same day, and store them for future use, if it becomes necessary. If the discharge continues to flow <br />on the days that the subsequent samples would normally have been collected, the permi[tee shall collect the sample in <br />accordance with the EPA guidance document. If the discharge flow has ceased, the permittee shall use the stored <br />samples and ship them to the laboratory as needed. The permittee shall follow the WET sampling guidance found in <br />EPA document EPA-600-4-91-002 when ever possible. <br />b. Failure of Test and Division Notification <br />Outfalls WTB (Outfall 004) and WTE (Outfall 008) -Beginning on the effective date of this permit, a chronic WET <br />test is failed whenever there is a statistically significant difference in l etha]ity hehveen [he control and any effluent <br />concentration less than or equal to the instream waste concentration ("IWC"). The IWC for all outfalls has been. <br />determined to be 100%_ The pennittee must provide written notification of the failure of a WET test to the Division, <br />along with a statement as to whether a Preliminary Toxicity Investigation ("PTI")/Toxicity Identification Evaluation <br />("TIE") or accelerated testing is being perforated. Notification must be received by the Division within 21 calendar <br />days of the demmtstration of chronic WI;T in Che routine required test. "Demonstration" for the purposes of <br />subparts b., c., d., e. and g. means no later than [he last day of the labora[oty test. <br />outfalls WTA (outfalls 003 and 003), Outfall WTC (Outfall 005), Outfall WTD (Outfall 006), Outfall WTF <br />(Outfall 010), Outfall WTG (Outfall Ol l), and Outfall WTI (Outfall 016 ahd 017) -Beginning on the effective date <br />of the limitation (January 1, 2008) a chronic WET test is failed whenever there is a statistically significant difference in <br />lethality between the control and any effluent concentration less than or equal to the instream waste concentration <br />("IWC"). The IWC for these outfalls has been determined to be 100%. The petntittee must provide written notification <br />of the failure of a WET test to the Division, along with a statement as to whether a Preliminary Tonicity Investigatimt <br />("PTI")/Toxicity Identification Evaluatimt ("TIE") or accelerated testing is being performed. Notitication must he <br />received by the Division within 21 calendar days of the demonstratimt of cJtronic WET in the routine required <br />test. "Demonstration" for the purposes of subparts b., c., d., e. and g. means no later than the last day of the laboratory <br />test. Prior to the limitation becoming effective, the pennittee is to monitor and report the WET test results for these <br />outfalls. <br />
