An acceptability determinaticn would be made by EL. :, and the <br />successful bidder would be notified and requested to subr.:it data and <br />information necessary for a revier;~ by the ittorney General. <br />The ELN must concur with any undereround mining permi± subc~itted to <br />OShI by a successful bidder and ray develop mitigating measures *_o be <br />included as stipulations in the lessee's plan. In general, as the <br />surface-managing aeency, the GLM develops the special requirer,ents to be <br />included in federal teal leases and reclamation plans related tc <br />management and protection cf all rescurces (ether than coal) and the <br />post-mining land use of the affecteG public lands. BL^1 is also <br />respor,si,ble for granting various rights-of-way for ancillary facilities, <br />such as access roads, power lines, co,Tr~iunication lines, and railroad <br />spurs on public lands. <br />U. S. Geological Survey (USGS) <br />In consultation with BLt~~, the USGS reviews short-tern coal lease <br />applications sub;r.itted under the criteria for short-terr^ leasing defined <br />by the June Ik, 19i.''., court decision in i;?CC vs Ni'cnes. Ine USGS then <br />• prepares coal resource economic evaluations to cetermir.e ±he ro~ralty <br />rates, necessary bones, rentals, economic feasibility of Wining *.he <br />coal, and caxir„um economic recovery for any short-ter lease tracts <br />• which qualify under the above criteria. The USGS also determines fair <br />market value for file coal to be leased. In order to obta,n pudic <br />comment cn such issues as fair market value, ~;~azimur,~ economic recovery, <br />etc., the USGS participates in the pre-lease hearing arranced by 6Lh. <br />The USGS must concur with any underground minine permit submitted <br />• to OSi~ by a successful bidder (lessee) and is responsible for <br />development, predcction, and coal resources recovery requirements <br />included in the mining pewit. <br />• U.S.~Fish and kildlife Service (USES) <br />The USFI;S is responsible for protec±ion of migratory birds, <br />including eacles, and threatened er endangered species and their <br />habitats. Coordination is required with the USFkS under provisions of <br />the Fish anal 4lildlife Coordination Act, the Bald Eagle Act, and the <br />Endangered Species Act. <br />n <br />
