Cattany <br />Division Director <br />Notice to Parties and Interested Persons to the Lupton Lakes Resources New Application Natural Resource Trustee <br />RE: Pre-hearing Conference and Formal Public Hearing for SW TKO Joint Venture, LLC, Lupton <br />Lakes Resources, File No. M-2004-078 <br />March 28, 2005 <br />Dear Party and/or Interested Person: <br />The Colorado Division of Minerals and Geology (DMG) has received objections to the application for the Lupton <br />Lakes Resources New 112c Application (File No. M-2004-078) submitted by SW TKO Joint Venture, LLC. <br />Comments and objections have been forwarded to SW TKO Joint Venture. <br />A Pre-hearing Conference has been scheduled to occur on Amri129, 2005, beginning at 1:00 p.m., at the Division <br />of Minerals and Geology, 1313 Sherman Street, Room 215, Denver, Colorado. Ms. Sandra Brown will preside as <br />Pre-hearing Conference Officer. The purpose of the Pre-hearing Conference is to describe the Office's review <br />process, to explain the rights and responsibilities of parties, to discuss and resolve issues to the extent possible, to <br />describe the Board Hearing processes, to determine the list of issues under the Board's jurisdiction and-to simplify <br />the list, and to determine who has demonstrated standing to be a party to the Formal Boazd Hearing. <br />Staff has scheduled the matter for Formal Public Hearing before the Colorado Mined Land Reclamation Board. <br />The hearing on the application for the Lupton Lakes Resources New 112c permit will occur during the May 11_ <br />12, 2005 $oazd meeting at 1313 Sherman Street, Room 318, Denver, Colorado, commencing at 10:00 a.m. on <br />May 11`" or 9:00 on May 12`" or as soon thereafter as the matter can be considered.
