An applicant will not be issued a reclamation permit until notified by the Division that
this application and the required performance and financial warranties have been
approved. NO MINTR~ OPERATIONS SHALL BEGIN UNTIL A PERMIT IS ISSUED (Rule 7.2(2)).
It shall be a provision of this permit that the operations will be conducted in
accordance with the. terms and conditions listed in your application, as well as with the
provisions of the Act and the Mineral Rules and Regulations in effect at the time the
permit is issued.
NOTE TO COMMENTORS/OBJECTORS: It is likely that there wilt be additions, changes, and
deletions to this document prior to final approval/denial by the Mined Land Reclamation
Board or Division. Therefore, if you have comments or concerns you should contact the
applicant or Division, prior to the approval/denial date so that you will know what
changes may have been made to the application docv ment.
The Division is not allowed to consider comments, unless they are written, and received
prior to the end of the public comment period. You should contact the applicant for the
final date of the public comment period. If you have questions about the Mined Land
Reclamation Board and Division's review and approval/denial, or appeal process, you
should contact the Division at [phone].
As an authorized representative of the applicant, I hereby certify:
1. All necessary approvals from local government have been applied for
(Rule 3.3(1 )(d ));
2. A copy of the notice, included as Exhibit E, has been delivered to each owner
of the affected lands and to each owner of lands within 200 feet of the affected
lands (Rule 3.3(1 )(k )).
3. The entire mining operation, as designed, will affect less than two acres,
and extract less than 70,000 tons of mineral, overburden, or combination thereof
per calendar year (Rule 3.3 );
4. No sand, gravel or quarry aggregate will be produced, no mining operations
will be located in or adjacent to a stream channel, or no minerals will be
processed by acid or toxic-forming chemical means (Rule 3.3 );
