NO MINTR~ OPERATIONS SHALL BEGIN UNTIL A PERMIT IS ISSUED (Rule 7.2(2)). <br />It shall be a provision of this permit that the operations will be conducted in <br />accordance with the. terms and conditions listed in your application, as well as with the <br />provisions of the Act and the Mineral Rules and Regulations in effect at the time the <br />permit is issued. <br />NOTE TO COMMENTORS/OBJECTORS: It is likely that there wilt be additions, changes, and <br />deletions to this document prior to final approval/denial by the Mined Land Reclamation <br />Board or Division. Therefore, if you have comments or concerns you should contact the <br />applicant or Division, prior to the approval/denial date so that you will know what <br />changes may have been made to the application docv ment. <br />The Division is not allowed to consider comments, unless they are written, and received <br />prior to the end of the public comment period. You should contact the applicant for the <br />final date of the public comment period. If you have questions about the Mined Land <br />Reclamation Board and Division's review and approval/denial, or appeal process, you <br />should contact the Division at (303) 866-3567. <br />As an authorized representative of the applicant, I hereby certify: <br />1. All necessary approvals from local government have been applied for <br />(Rule 3.3(1 )(d )); <br />2. A copy of the notice, included as Exhibit E, has been delivered to each owner <br />of the affected lands and to each owner of lands within 200 feet of the affected <br />lands (Rule 3.3(1 )(k )). <br />3. The entire mining operation, as designed, will affect less than two acres, <br />and extract less than 70,000 tons of mineral, overburden, or combination thereof <br />per calendar year (Rule 3.3 ); <br />4. No sand, gravel or quarry aggregate will be produced, no mining operations <br />will be located in or adjacent to a stream channel, or no minerals will be <br />processed by acid or toxic-forming chemical means (Rule 3.3 ); <br />
