Simpson, P.E. <br />State Engineer <br />~~~ ~~ <br />Dear Mr. Dunn: <br />We have reviewed your January 13, 2004 request for a substitute water supply plan on <br />behalf of Castle Concrete Company. The required $1,343 fee has been received. A well permit <br />application has been submitted, receipt no. 519831. <br />This operation is estimated to last 5 years. An area of 35 acres will be mined exposing <br />ground water. The pit will be dewatered into a 5 acre settling pond. The depletions of this <br />operation consists of 15.2 acre-feet of evaporative loss from exposure of 5 acres of water, 4.9 <br />acre-feet of water removed via 165,000 tons mined product (4% loss by weight), and 5.8 acre- <br />foot pumped for dust suppression. A monthly breakdown of these amounts and their lagged <br />affects on the Arkansas River is given on Table 1, attached. <br />The pit will be located less than 100 feet from the Arkansas River, and so the depletions <br />are considered to be instantaneous. The proposed source of replacement water is the dry-up <br />of 40 of 97 acres of alfalfa historically irrigated with Lester Attebery Ditch water. 60 shares of <br />Twin Lakes Reservoir water will cover the replacement water for the winter months. Should the <br />dewatering of the pit cease, there is adequate replacement water to cover 40 acres of exposed <br />ground water. <br />The state and division engineers have reviewed the plan and the adequacy of each <br />source of water provided for use as augmentation water, including, where necessary, the <br />historical consumptive use of each water right, and return flows from diversion of waters <br />imported into the Arkansas River Basin or other fully consumable waters proposed for use as <br />augmentation water. In accordance with Section 25-8-202(7), C.R.S. and Senate Bill 89-181 <br />Rules and Regulations adopted on February 4, 1992, the state engineer has determined that <br />subject to the terms and conditions below, the replacement supply is of a quality to meet the <br />requirements of use to senior appropriators. <br />This substitute water supply plan is hereby approved pursuant to Section 37-90-137(11), <br />C.R.S., subject to the following conditions: <br />
