Such modifications include the enlargement of the pond by removing additional material <br />upstream of the dam. <br />To the best of my knowledge, based on my professional expertise, Refirse Area Sediment Pond 4 at <br />the Deserado mine was constructed in conformance with prudent state-of--the-art construction <br />practices. Further, [he structures were constructed in compliance with [Ite approved design, as <br />specified within Section IV.J of the approved permit documents and depicted on Map 80 and other <br />permit documents or maps as amended from time to time. Map 80 enclosed herein is a true <br />representation of Sedimentation Pond 4 as constructed. <br />certify, based on my field observations and those observations of my qualified designates and <br />professional investigations, as detailed above, that Refuse Area Sediment Pond 4 at Blue Mountain <br />Energy, Inc., Deserado Mine, located in Rio Blanco County, Colorado, were constructed in <br />compliance with the design approved as a portion of Permit No. C-018-81, issued by the Colorado <br />Division of Minerals and Geology. <br />Respectfully, <br />Gc/GiG~.-er,~, ~ y~-- <br />William C.
