Cottony <br /> Acting Division Director <br />~• <br />Re: Westside Gravel, File No. M-2003-003, New 112c Application, Preliminary Adequacy Reyiew Letter. <br />Dear Mr. Shaw, <br />I have completed my preliminary review of the new 112c permit application named above, and have a few <br />questions which must be addressed before the decision date. Please respond as completely as possible to each of <br />the following items which request clarification. Arranging your responses in the same order as this letter or <br />properly labeling them will facilitate our review: <br />Exhibit C -Pre-mining and Mining Plan Maps (Rule 6 4 31 <br />The adjoining landowner map (Exhibit C-a) shows a 200-acre parcel and the parcels adjoining or within 200 feet on <br />all sides of it. The proposed permit area is 100 acres, but it is not specifically delineated on the map. It is presumed <br />to consist of the western half of the delineated 200-acre parcel Please clarify this. <br />The landowner map also contains two numbered parcels which lie within 200 feet of the proposed boundary, but <br />are not identified as the owners on the list of landowners. The pazcel numbers aze: Ref # 25709 and Ref # 25719. <br />Please provide the names of these parcel owners. <br />The list of affected and adjoining landowners contains the name Robert P. Johnson, who is indicated as the owner <br />of the parcel upon which this proposed permit is located (Ref # 25817). Elsewhere in the application you have <br />identified the affected landowner as "Durango PTR Properties, LLC." Please clarify this discrepancy. <br />The Pre-mining Map (Exhibit C-b) and the Reclamation Map (Exhibit F) show several surveyed and locatable <br />comers, with a metes and bounds perimeter description. These two maps do not contain a labeled "permit area <br />boundary," nor a labeled "affected area boundary." Since the proposed permit acreage is represented as <br />"approximately 100 acres" (per Exhibit A), the boundary is assumed to possibly be defined by these surveyed <br />points shown on the map. However, since a significant segment of the county road lies wholly within the area these <br />points define, it becomes unclear whether you plan to affect areas west of the county road or exactly where the <br />boundary is. Since these two maps, as well as Mining Map Phase 1 and 2 (Exhibit C-c), contain no labeled <br />boundaries, you must revise the maps and provide the corrected versions. Please be reminded that if you plan to <br />delineate specific areas of your permit which will not be affected (such as west of the county road or a buffer <br />around the perimeter), by delineating those areas you will be defining the "affected area boundary," which must be <br />labeled also. <br />All maps must be prepared by a person qualified to do so, and signed and dated by the person preparing the maps. <br />The scale shown on the maps is incorrect. Please provide the correct scale on the revised maps. <br />
