Michelle Matthews <br />September 29, 2003 <br />Page 5 <br />by the pumping of each well or farm unit in the plan with the actual depletions from <br />reported pumping. Action shall be taken if the total pumping by a well user covered by <br />the plan is about to exceed an amount for which replacement water has been <br />purchased. Options for appropriate actions are to: <br />a) Notify the division engineer when a well user's pumping is out of compliance with <br />the terms of the approved plan and request that the division engineer stop the <br />well from pumping in excess of its limits. <br />b) Notify the division engineer of the purchase of more replacement water, in <br />addition to the water already purchased for the plan, to cover the additional <br />depletions caused by any additional pumping by the well or wells in question. <br />c) Notify the division engineer of a reallocation of the replacement water already <br />purchased or otherwise available to the plan. Indicate to the division engineer <br />which wells covered by the plan will pump less than originally planned or <br />alternatively demonstrate that existing replacement sources will make available <br />sufficient quantities to allow additional pumping by the well or wells in question. <br />10. Should a request for renewal of this plan be needed, such renewal request must be <br />submitted to this office and the division 2 office at least 90 days prior to the expiration date <br />of this plan (January 1, 2004). <br />11. In accordance with amendments to Section 25-8-202-(7), C.R.S. and "Senate Bill 89-181 <br />Rules and Regulations" adopted on February 4, 1992, the state engineer shall continue to <br />determine whether or not the replacement supply is of a quality to meet requirements of <br />use to senior appropriators. As such, water quality data or analysis may be requested at <br />any time to determine if the water quality is appropriate for downstream water users. <br />12. No change or improvement of the delivery or application method of water from member <br />wells may be made that would result in material depletion of usable quantity or <br />availability for use of water to users in Colorado and Kansas in violation of Paragraph D, <br />Article IV, of the Arkansas River Compact. <br />13. Acceptance of these conditions shall be assumed unless a letter to the contrary is <br />_ _ received by this office, the_Division Engineer (Stev_e Witte1310 E.
