i.: <br />Michelle Matthews Page 2 <br />September 29, 2003 <br />Two (2) gravel pits R.B.K Baxter Road Pit (ID 1406561, DMG No. M-90-106) and Lafarge <br />Evan's #2 Pit (ID 1406563, DMG No. 00-041) will be authorized to operate pursuant to separate <br />substitute water supply plans (administered by MAGUA), and one other well (ID 1406316) was a <br />past member that is included in this plan only to cover lagged depletions from pumping during <br />previous plan years. <br />The 18 active wells in this plan divert water for a variety of uses that include domestic <br />use, lawn and nursery irrigation, animal watering, pond evaporation, and consumption from <br />gravel pits. For the 2003-2004 period, there will be 165.7 acre-feet of diversions from active <br />wells in this plan. Estimates of total pumping for the 2003 plan year are provided for each well <br />in your Table 1. You have reported that 16.13 acre-feet of additional water will be administered <br />by MAGUA for the R.B.K Baxter Road Pit and Lafarge Evan's #2 Pit under separate approvals. <br />The estimate of potential out-of-priority depletions to senior surface water rights in <br />Colorado, to be replaced during this plan year, are 127.1 acre-feet based upon the actual <br />pumping from previous plan years, estimates of depletions based on the review of depletion <br />information submitted for the wells pursuant to Rule 4.2d of the Rules, and the delayed <br />response of well pumping on the surface streams. Your tables 2 and 3 (attached) show the <br />individual well stream depletion factors and replacement requirements. Of the total amount of <br />stream depletions, 27.7 acre-feet will accrue to Fountain Creek and 99.4 will accrue to the <br />Arkansas River. These calculated stream depletions do not take into account depletions <br />caused by Baxter Pit or Lafarge Evan's No. 2 pit because these gravel pits operate under their <br />own substitute water supply plans and provide their own replacement water. <br />The Arkansas Groundwater Users Association (AGUA} will purchase reusable return <br />flows from the Cherokee Metropolitan District (Cherokee), to be used to replace the 2003 plan <br />year stream depletions attributable to MAGUA's wells. The necessary replacement water, <br />including transit losses, will be provided by agreement between AGUA and MAGUA. The RBK <br />Baxter Road Pit and LaFarge Evans #2 Pit have separate water contracted with the Board of <br />Water Works of Pueblo for 21.0 and 20.8 acre-feet of transmountain water or reusable return <br />flows, respectively. MAGUA proposes to use the following specific sources and quantities of <br />replacement water to allow continued well pumping: <br />1. Lease from the Cherokee Metropolitan District (Cherokee) through the Arkansas <br />Groundwater Users_Association (AGUA~dedicated to MAGUA for up to 15_2.5 acre-feet . <br />of reusable return flows. A transit loss of 10% on Sand Creek, 7% on Fountain Creek, <br />and 1% on the Arkansas River between Fountain Creek and fhe points of depletion has <br />been calculated for the Cherokee water in making replacements under this plan. This <br />lease, after calculated stream depletions, will provide 27.7 acre-feet of replacement <br />water on Fountain Creek and an additional 101.9 acre-feet of replacement water on the <br />Arkansas River. The lease is valid though this approval period, March 31, 2004. <br />Because 100% of the out-of-priority depletions to senior surface water rights in Colorado <br />will be replaced during this plan year, no additional quantity has been determined for the <br />replacement of depletions to usable stateline flow. The effectiveness of this replacement plan in <br />replacing depletions to usable stateline flow will be evaluated following the end of the plan year <br />to determine if any additional replacements are required to replace depletions to usable <br />stateline flow caused by post-compact diversions of ground water pursuant to this plan. <br />
