JBCO <br />Hartman Pit <br />Dear Kim: <br />Condition l7 of [his permit states: "Notwithstanding the regulation administered by the State of <br />Colorado Land Reclamation Division. during reclamation of the disturbed areas, an eighteen inch <br />(18") high berm will be established to prevent erosion." <br />We designed our rec]amation plan to conform to that condition. When we submitted the application <br />to the Division of Minerals and Geology and the MLRB, it was reviewed by Larry D. Oehler. <br />Envirottmental Protection Specialist for the Division. He Recommended that the berm be removed <br />for what appears to be valid reasons. (I am enclosing a copy of his letter.) Since they are basically <br />responsible for reclamation and administering the required bond -probably 50.000 in this situation, <br />it seems logical to us to go with their recommendation. <br />Therefore, we would like to request at the January, 1998 Commission meeting that Item 17 be <br />deleted from the permit conditions.
