HARTMAN AND CO., B.L. HARTMAN AND CO. (LAND <br />OWNERS) LANE 36, VINELAND AREA <br />BACKGROUND <br />Special Use Permit No. 97-09 allowing Natural Deposits, Extraction, and Processing in an A-1 <br />Zone District, was approved by the Pueblo County Planning Commission June 24, 1997 with 19 <br />conditions. Condition No. 17 states: <br />Notwithstanding the regulations administered by the State of Colorado Mined <br />Land Reclamation Division, during reclamation of the disturbed areas, an <br />eighteen inch (18') high berm will be established to prevent erosion. <br />The applicant's agent contacted this Department and requested this condition be deleted from <br />the special use permit to avoid conflict with the permitting process of the State of Colorado, <br />Division of Minerals and Geology (Exhibit 1). The Division of Minerals and Geology, in their <br />comments related to Exhibit E -Reclamation Plan, refers to this cendition in a letter to Mr. <br />Barnhart, dated December 12, 1997, as follows (Exhibit 2): <br />"The Division recommends that the berm around the edge of the reclaimed area <br />be taken out of the plan. Such a berm would not be constructed on the level <br />(contour) and would act as a diversion overland flow. The diverted water would <br />no doubt break the berm in low areas concentrating flows and causing erosion of <br />the hill slopes below the pit and in some instances possible off site damage. <br />Such berms unless build (sic) on the contour or to a grade not exceeding 2 or <br />3% and spilling to a constructed catchment basin or protected waterway could do <br />more harm than good. Establishment of a good vegetative cover would be a <br />better erosion control method." <br />1120 CGURT STREET.
