JBCO (APPLICANT), C/O BUCK BARNHART, (AGENT), STATE OF
COLORADO, K.J. HARTMAN AND CO., B.L. HARTMAN AND CO. (LAND
OWNERS) LANE 36, VINELAND AREA
BACKGROUND
Special Use Permit No. 97-09 allowing Natural Deposits, Extraction, and Processing in an A-1
Zone District, was approved by the Pueblo County Planning Commission June 24, 1997 with 19
conditions. Condition No. 17 states:
Notwithstanding the regulations administered by the State of Colorado Mined
Land Reclamation Division, during reclamation of the disturbed areas, an
eighteen inch (18') high berm will be established to prevent erosion.
The applicant's agent contacted this Department and requested this condition be deleted from
the special use permit to avoid conflict with the permitting process of the State of Colorado,
Division of Minerals and Geology (Exhibit 1). The Division of Minerals and Geology, in their
comments related to Exhibit E -Reclamation Plan, refers to this cendition in a letter to Mr.
Barnhart, dated December 12, 1997, as follows (Exhibit 2):
"The Division recommends that the berm around the edge of the reclaimed area
be taken out of the plan. Such a berm would not be constructed on the level
(contour) and would act as a diversion overland flow. The diverted water would
no doubt break the berm in low areas concentrating flows and causing erosion of
the hill slopes below the pit and in some instances possible off site damage.
Such berms unless build (sic) on the contour or to a grade not exceeding 2 or
3% and spilling to a constructed catchment basin or protected waterway could do
more harm than good. Establishment of a good vegetative cover would be a
better erosion control method."
