Long <br />Re: Brown Derby Mine, File No. M-99-074, Receipt of 110(2) Hard Rock/Meta1 Mining Reclamation Permit~o~ D~recror <br />Application Package <br />Dear Ms. Yoder: <br />On September 20, 1999, the Division of Minerals and Geology received your the 110(2) Hard Rock/Metal Mining <br />Reclamation Permit Application package for the Brown Derby Mine, File No. M-99-074. Preliminary review of the <br />information received determined that the following items must be received before the Division can consider your <br />application as being submitted and technical review can begin: <br />EXHIBIT G -Source of l.e~al~tiEht~o-Enter (Rule 6.3.71: Provide a description of the basis for legal right <br />of entry to the site and to conduct mining and reclamation. This may be a copy of access lease, deed, abstrac[ <br />of title, or a current tax receipt. A statement by the Landowner and acknowledged by a Notary Public stating <br />that you have the legal right to enter and mine is also acceptable. <br />EXHHIiT I -Proof of Filingwith Courtly Clerk (Rule 6.3.9): Provide an affidavit or receipt indicating the <br />date on which the application was placed with the local County Clerk and Recorder. Also, refer to Rule <br />1.6.2(1)(c). <br />EXHIBIT J -Proof of MailirrP Notices of Permit Application (Rule 6.3.101: Include proof of mailings of <br />the "Notice of Permit Application" sem to the County Board of Commissioners and Board of Supervisors of the <br />local Soil Conservation District, in the application, by submitting the date-stamped receipt for Certified Mailing <br />or adate-stamped copy of the notice form with signature acknowledging personal service and receipt by the <br />appropriate board. Also, refer to Rule 1.6.2(1)(a). <br />Your application will not be considered filed until the information listed above is received and found sufficient to begin <br />our review. A decision dale will be established 30 days from the date of receipt of all of the requested information. <br />Additionally, if you have already published notice you will need to republish notice, after the Division considers the <br />application submitted. Republication must occur once within ten (10) days of the submittal date. We will notify you <br />when you should initiate republication of your notice. The fmal date for receiving comments is ten (10) days after the <br />date of publication or the next regular business day. <br />This letter shall not be coosttued to mean that [here ate no other technical deficiencies in your application.
