You will
note that the effluent was acutely toxic to Ceriodaphnia dubia. Upon notification of this
failure, Bear Coal elected to perform a "Preliminary Toxicity Identification (PTI)," as
opposed to accelerated testing. Past history of the accelerated testing has proven to be a
waste of time and resources. Enclosed in this report is the complete Preliminazy Toxicity
Identification Report which verifies the cause of the past WET Test failures. Based on
these test results as well as past PTI results, Bear Coal Company is requesting relief from
the Colorado Department of Health to exchange the Ceriodaphnia dubia with the
Ceriodaphnia magna. You will note that Bear Coal has used the Ceriodaphnia magna as
a supplemental species and results show 100 percent survival.
If you have any questions regarding this submittal please contact me at (970)929-
5258.
Sincerely;
//'~G~!//~~/~
~/: Daniel E.
