Your letters described the condition of the ponds prior to the rain events and precipitation
was reported to be 3.74 inches on April 29, 1999 which is greater than the 10-year/24-hour storm volume for the area.
Your sediment ponds are designed to Veat and contain a 10-year/24-hour precipitation event. The self-monitoring
data you provided on your Discharge Monitoring Report is shown below:
Reported Permit
Period Outfall Parameter Results Conditions
2Q99 OOIA TSS, (mg/I) 59 (30 day avg) 35 (30 day avg)
2Q99 OOIA TSS, (mg/I) 122 (daily mx) 70 (daily mx)
2Q99 002A TSS, (mg/I) 158 (30 day avg) 35 (30 day avg)
2Q99 002A TSS, (mg/I) 158 (daily mx) 70 (daily mx)
2099 002A L-on Total 'm n`
to •i 7.36 7~ da-~ av-
( Y 5) 3.5 30 da av
( Y b
2Q99 002A Iron, Total (mg/I) 7.36 (daily mx) 7.0 (daily mx)
2Q99 004A TSS, (mg/I) 60 (30 day avg) 35 (30 day avg)
2Q99 004A TSS, (mg/I) 120 (daily mx) 70 (daily mx)
Energy Fuels Coal, Inc. has shown [hat discharge occurred within 48 hours after measurable precipitation and that
discharge from the various Outfalls was beyond your control. Therefore, we believe that Energy Fuels Coal, Inc.
qualifies for the greater than 10-year/24-hour precipitation alternate limit, thus waiving Total Suspended Solids and
To[al Iron limits.
If you have any further questions regarding this matter, please contact me at (303) 692-3603.
S' cer ly,
Carla ].
