Waltz <br />Re: Objections toAmended Reclamation Permit Application # M-2004-067 C.Qaa01J~" <br />• Dear Mr. Schreiner: <br />As you know, this firm represents the City of Black Hawk, which as been made a party to <br />proceedings related to your File No. M-2004-067 based on its potential aggrieved status and its <br />prior objection letter filed with your office on December 30, 2004. <br />On behalf of the Mayor and Boazd of Aldermen, please let this correspondence serve as <br />the City's renewed objection to the above-referenced permit application, which was amended by <br />the applicant's adequacy response dated Mazch 25, 2005, and was given a revised date of filing <br />by your office of April 11, 2005. <br />As we discussed in our telephone conversation of April 27, 2005, the City remains <br />strenuously opposed to the amended application, renews its opposition to the application, and <br />would like to enswe that the Division consider its prior objection letter in its review of the <br />amended application. In addition, the City now submits the following additional objections <br />through the letters attached hereto in which Ms. Katie Fendel, Project Manager, Leonard Rice <br />Engineers, Inc., and Ms. Denise E. Larson, Ecologist, ERO Resources Corp., have evaluated <br />application # M-2004-067 for compliance with MLRB Rules. <br />You indicated, and Mr. Steve Brown of the Attorney General's Office confirmed in a <br />phone conversation on the same day, that the City's party status would be preserved going <br />forward and that the City's prior objections would be considered during the Division's review of <br />• the amended application.
